Do You Need a Small Claims Lawyer?

Small Claims Court is designed to be more relaxed than Civil Courts to afford people access to justice.  But does this mean that you are prepared to proceed on your own?  It is a question that many people ask themselves and the answer varies from person to person. 

Like many Courts, there will be limitation periods, time sensitive documents that must be filed through the portals, and hearings that require your attendance.  Failure to execute any of the above can result in your claim being dismissed, being noted in default and or having costs awarded against you.  Any of these consequences can affect you greatly and awards against you could be as high as $35,000. 

Appealing matters are more costly than dealing with the initial matter properly.  When you are unsuccessful in any Small Claims matter, the option to appeal to a higher Court is always available.  But this can come at a much higher cost than if you had represented yourself properly during the initial proceedings.
