Divisional Court Appeals

When you receive a Final Order from the Landlord and Tenant Board of Ontario you have a right to request a review or appeal the decision.  Time is of the essence on these matters as under most circumstances you only have 30 days to act before the limitation period expires.

It is imperative that you contact legal representation immediately upon receiving a Final Order to ensure your rights are preserved.

Rasouli Law can intervene on your behalf to ensure that you receive a review of the issued decision and or file an appeal before the Divisional Court.

Did you know that statutory Stay's are granted upon filing an appeal?

If you've received a Final Order for eviction and termination of your tenancy you have two options available to you:

  • You can request a review of the decision to ensure that the Adjudicator properly assessed the facts, evidence and applied the law in their decision to grant an Eviction Order.

  • You can subsequently file an Appeal before the Divisional Court that will grant a statutory Stay of the Order until the Appeal is reviewed and or a decision is made.

Just because you have received a decision to terminate your tenancy and evict you from the unit doesn't mean you have lost your fight.  Contact us today to have your matter reviewed by an experienced and qualified lawyer to see what options might be available to you.
